This data protection declaration applies to the website www.yamaichi.de operated by Yamaichi Electronics Deutschland GmbH and Yamaichi Electronics Deutschland Manufacturing GmbH as well as the Y-Circ P configurator together with all sub-pages.

I. Provision of the website


1. Description of the data processing

Every time you visit our website, our system automatically collects data and information from the computer system of the accessing computer. The following data is collected:

(5) The date and time of access
(6) Websites from which the user's system accesses our website

The data is also stored in the log files of our system. This data is not stored together with other personal data of the user..

2. Purpose of processing and legal basis

Temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. To this end, the user's IP address shall remain stored for the duration of the session. The data is stored in log files to ensure the website's functionality. The data is also used to optimise the website and to ensure the security of our information technology systems. No evaluation of the data for marketing purposes is undertaken in this context.

The legal basis for temporary storage of data is Art. 6 para. 1 (f) of the GDPR. The legitimate interest in data processing pursuant to Art. 6 Para. 1 (f) GDPR results from the maintenance of the functionality of the website.

3. Receiver of data and storage duration

The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. In the case of data collection for provision of the website, this will be undertaken once the respective session has ended.

If the data is stored in log files, this will be undertaken after seven days at the latest. Further storage is possible. In this case, the user's IP addresses will be deleted or distorted, so that assignment of the accessing client is no longer possible.

4. Objection and removal option

Collection of data for provision of the website and storage of data in log files is absolutely necessary for operation of the website. Consequently, there is no option to object on the part of the user.

Our website uses cookies. Cookies are text files that are stored in the Internet browser or by the internet browser on the user's computer system. If a user visits a website, a cookie may be stored on the user's operating system. b. Google Analytics

The purpose of the cookies used by Google Analytics is to analyse your use of the website. On our behalf, Google will use this information to evaluate the use of our online offering by the user, to compile reports on the activities within this online offering and to provide us with other services related to the use of this online offering and the internet. Pseudonymous usage profiles of users may be created from the processed data in this respect. We use Google Analytics only with activated IP anonymisation. This means that the IP address of the user is shortened by Google within the member states of the European Union or in other countries that are party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. The IP address sent by your browser will not be connected with other data from Google. The legal basis for processing is your consent under Art. 6 Para. 1 (f) of the GDPR. The legitimate interest in the processing of personal data pursuant to Art. 6 Para. 1 (f) GDPR consists in the demand-oriented design of our website.

3. Receiver of data and storage duration

The information received through the cookies of Google Analytics for the use of the online offer is usually transmitted by Google to a server in the USA and stored there. All further information due to technically necessary cookies will not be passed on by us to third parties and will be deleted as soon as it is no longer necessary to achieve the purpose of its collection. User data will be deleted after 14 months at the latest.

4. Objection and removal options

a. Cookies

As a user, you have control over the use of cookies on your computer. By changing the settings in your Internet browser, you can disable or restrict the transmission of cookies. Cookies that have already been saved can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all of the website's features in full. The transmission of Flash cookies cannot be prevented via the browser settings, but by changing the Flash Player settings.

III. Social plug-ins


1. Description of the data processing

On our website you will also find buttons that allow you to interact with various social media networks. You can activate this social plug-in ("plug-ins"), whereby the activation has the consequence that in particular the address of the web page on which the activated plug-in is located, date and time of the call of the web page, information about the used browser and the operating system used as well as their current IP address are transferred to the respective social media offerer in this case. If you are already logged in to the corresponding networks at the time of activation of the plugin, the plugin is also able to determine your user name and, if necessary, your real name from the above-mentioned data.

Our website uses plug-ins from the social network facebook.com. The plug-ins are identifiable by a Facebook logo (white "F" on a blue tile, the terms "Like" or a "thumbs up" sign) or are marked with the phrase "Facebook Social Plugin".


b. Kununu and XING

Our job offer uses the buttons Kununu and XING. With the help of the buttons you have the possibility to go directly to the career portals and to view our and other job offers.


2. Purpose of processing and legal basis

a. Facebook
The purpose and scope of data collection and the further processing and use of the data can be found under Facebook's privacy policy https://www.facebook.com/about/privacy/. When a user accesses a feature of these online offerings that contain such a plug-in, his/her device establishes a direct connection to Facebook's servers. The content of the plugin is transmitted by Facebook directly to the user's device and integrated into the online offer. Pseudonymous usage profiles of users may be created from the processed data in this respect. We therefore have no influence on the scope of the data which Facebook collects using this plugin and inform you based on our knowledge: By integrating the plugins, the companies receive information that a user has called up the corresponding page of the online offer. If the user is logged in to Facebook, the respective company can assign the visit. If you interact with the plug-ins, for example, if you click the Like button or write a comment, the corresponding information is transmitted from your browser directly to Facebook and stored there. If you are not a member of Facebook, there is still the possibility that Facebook will receive your IP address and store it. According to Facebook, in Germany, only an anonymised IP address will be stored. The legal basis for the use of the Facebook plugin is the legitimate interest in data processing pursuant to Art. 6 Para. 1(f) of the GDPR. The legitimate interest results from the provision of a comprehensive offer on our website.

b. XING and Kununu
When a user accesses a website on these portals, his/her browser establishes a direct connection to the servers. The content of the buttons is transmitted directly to the user's browser. We therefore have no influence on the amount of data that XING or Kununu collects with the help of this plug-in. The legal basis for the use of the Facebook plugin is the legitimate interest in data processing pursuant to Art. 6 Para. 1(f) of the GDPR. The legitimate interest results from the provision of a comprehensive offer on our website.

3. Receiver of data and storage duration

a. Facebook
According to Facebook's privacy policy (Facebook Ireland Ltd., 4 Grand Canal Square
Grand Canal Harbour, Dublin 2 Ireland) the information is shared internally within the group or with third parties. Instagram was purchased by Facebook in 2012 and the company states in the privacy policy that the information will be exchanged between the companies. Information collected in the European Economic Area ("EEA") may be transferred to countries outside the EEA, for example, for the purposes described in the Directive. Facebook states that it uses standard contractual clauses approved by the European Commission, takes other measures under EU law and obtains your consent to legitimise data transfers from the EEA to the US and other countries. Facebook declares that it will store the data for as long as necessary to provide users and other products and services. The information associated with the user account remains on Facebook, Instagram and You Tube until the account is deleted, unless the company no longer needs the data to provide products and services. 

b. XING and Kununu
According to XING's privacy policy, personal data will only be disclosed to third parties if this is necessary to fulfil its own business purpose (e.g. if the profile is made accessible to another user), if consent has been given for this purpose, or if XING is required to do so by law or by a court or official order.

a. Facebook

IV. Newsletter

1. Description of the data processing
You can subscribe to a free newsletter through our website. The data from the input screen is sent to us when you subscribe to the newsletter. As mandatory information you only have to enter the email address. You can voluntarily provide your first name, surname, company, address, postcode and city, country, email and the message to YAMAICHI as well as telephone number and fax. We also store the IP address of the calling computer and the date and time of registration. During the registration process, your consent is obtained for processing data and reference is made to this data protection declaration. The data will be used exclusively for sending the newsletter

2. Purpose of processing and legal basis
Collection of other personal data as part of the subscription process is for preventing the misuse of the services or of the used email address. The legal basis for the processing of the data after registration for the newsletter by the user is the consent pursuant to Art. 6 Para. 1(a) of the GDPR.

3. Receiver of data and storage duration
The data will be passed on to dispatch service providers for the transmission of the newsletter and deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. The user's email address will therefore be stored for as long as the subscription to the newsletter is active. The other personal data collected during the registration process will generally be deleted after a period of seven days

4. Objection and removal options
The subscription to the newsletter can be cancelled by the user at any time. A link to do this can be found in every newsletter. This also enables withdrawal of consent for storage of personal data collected during the subscription process.

 

V. Contact form and email contact


1. Description and extent of the data protection agreement 

There is a contact form on our website that can be used for electronic contact. If a user accepts this option, the data entered in the input screen will be transmitted to us and stored. Mandatory information is the email address, as voluntary information you can enter your first name, surname, company, address, postal code and city, country, email and the message to YAMAICHI as well as telephone number and fax. As voluntary information you can also enter the department, telephone number and fax number.

At the time the message is sent, the following data is also stored: The IP address of the user and the date and time of registration. During the sending process, your consent is obtained for processing data and reference is made to this data protection declaration. Alternatively, you can contact us via the provided email address. In this case, the user's personal data that is transmitted along with the email will be stored. The data will not be disclosed to third parties during the course of this. The legal basis for processing the data, if the user's consent to this has been obtained, is Art. 6 Para. 1 (a) of the GDPR.
The legal basis for processing the data transferred in the course of sending an email is Art. 6 Para. 1 (f) of the GDPR. If the email contact aims at the conclusion of a contract, then an additional legal basis for the processing is Art. 6 Abs. 1 (b) of the GDPR.

3. Receiver and duration of storage
The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. For the personal data from the contact form input screen and the data that was sent by email, this is the case when the respective conversation with the user has been completed. The conversation will have ended when it is evident from the circumstances that the matter at hand has been conclusively resolved. Personal data that was additionally collected during the sending procedure will be deleted at the latest after a period of seven days.

4. Objection and removal options
The user has the option of revoking his or her consent to the processing of personal data at any time. A user who has contacted us by email can object at any time to the storage of his or her personal data. It will not be possible to continue the conversation in this case. The objection must be addressed to info@yamaichi.de. ll personal data stored in the course of contacting us will be deleted as a result.

 

VI. Configurator


1. Description and scope of data processing

With our online configurator, you have the possibility to configure Y-CIRC P connectors according to individual requirements. You can access the configurator either via a login or via a guest account. You do not need to enter any further data for guest access. In this case, only your IP address is stored.

2. Purpose of processing and legal basis
Temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. To this end, the user's IP address shall remain stored for the duration of the session. The legal basis for processing is your consent under Art. 6 para. 1 (f) of the GDPR. The legitimate interest already arises from the processing purpose.

The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected.

4. Objection and removal options
The collection of the data for the provision of the configurator and the storage of is absolutely necessary for the operation of the website. Consequently, there is no option to object on the part of the user.

 

VII. Applications


1. Description of the data processing

You can use our online career function to find out about vacancies and apply online. You must enter your first name, last name, email address, title, date of birth, address and your telephone number as mandatory fields. As further mandatory information, we need the upload of your CV. You can also voluntarily tell us in your upload documents which area you are interested in, the earliest possible starting date and your salary expectations as well as your application picture.

2. Purpose of processing and legal basis 
Your data will be processed to process your application. On the basis of the data you submit online, we make a preliminary selection for filling the position. The legal basis for processing is your consent under Art. 6 Para. 1 (a) (consent) GDPR.

3. Receiver and duration of storage
Your data will be transmitted encrypted to Yamaichi Electronics Deutschland GmbH and then made available to the personnel department of Yamaichi Electronics Deutschland GmbH. If we cannot take you into account when filling the vacancy, you will be informed by email. The data will then be made anonymous within or after 6 months at the latest.

4. Objection and removal option
The user has the option of revoking his or her consent to the processing of personal data at any time. In this case, the application process is terminated and the data is made anonymous. After deletion of your account, your data, including attachments and e-mails, will be deleted or made anonymous for application and used for statistical purposes. What is not anonymised is the reference to the job the applicant applied for, the number of interviews and file circulations and the gender.

 

VIII. Trade fair contacts, business cards


1. Description of the data processing

If you hand over your business card to us at trade fairs or other business events, we will store the information provided such as your name, telephone number, email address, position and in our CRM system. We will then contact you by email and ask for your consent by opt-in so that we can inform you about future products, innovations or activities or offers of our company that may be of interest to you.

The purpose of processing is the transmission of information from our company. The legal basis for processing is your consent under Art. 6 Para. 1 (a) (consent) GDPR.

3. Receiver and duration of storage
Your data will be stored in our CRM database. The data will be deleted immediately if you do not give us your consent within one month after sending the confirmation email to you via opt in. If you give your consent, we will process the data for your current information.

4. Objection and removal option
You have the possibility to revoke your consent to the processing of personal data at any time. In this case we will not send you any further information and the data will be deleted. 

C. Rights concerned

If the legal requirements are met, you have the following options pursuant to Art. 13 para. 2, 15 to 22 GDPR.

I. Right to information

You have the right to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you may obtain information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if this has not been collected by us, and requires the existence of automated decision-making including profiling and, where appropriate, meaningful information about its detail. II. Rectification, erasure, restriction of processing and data transferability

Furthermore, if the legal requirements are met you have the right

  • to immediately request the correction of incorrect or complete personal data stored by us in accordance with Art. 16 GDPR;
  • to request the deletion of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • to demand the restriction of the processing of your personal data in accordance with Art. 18 GDPR, as far as the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and we no longer need the data, but you still need this to assert, exercise or defend legal claims or you have objected to processing in accordance with Art. 21 GDPR;
  • to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request its transfer to another responsible person in accordance with Art. 20 GDPR.

III. Right to object

If your personal data is processed based on legitimate interests in accordance with Art. 6 para. 1 sentence 1 (f) GDPR, you have the right in accordance with Art. 21 GDPR to object to the processing of your personal data if there are reasons for this which arise from your particular situation or if the objection is directed against direct advertising. In the latter case, you have a general right to object, which we will implement without specifying a particular situation. IV. Revocation of consent

You have the right at any time to revoke your data protection declaration of consent. The withdrawal of consent shall not affect the lawfulness of processing taking place on the basis of this consent before its revocation.

V. Supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right of appeal to a supervisory authority, in particular in the Member State where you reside, work or where the infringement is suspected, if you believe that the processing of personal data that concerns you is in contravention of GDPR. The supervisory authority with which the appeal has been lodged shall inform the appellant of the status and results of the appeal, including the possibility of a judicial remedy under Art. 78 GDPR.
